By accessing and using MTK Rocks (Musician's Toolkit), you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service govern your use of the application and all its features.

2. Description of Service

MTK Rocks is a web-based music education and practice tool that provides:

• Interactive music scale exploration and visualisation
• Virtual instruments including piano, guitar fretboard, bass, ukulele, banjo, violin, and dulcimer displays
• Music theory educational content and resources
• Practice tools and audio playback features
• Circle of Fifths, Negative Harmony Calculator, and Scale Discovery tools
• Chord Dictionary with CAGED diagrams and voicing guidance
• Note Trainer for sight-reading practice
• User account management and progress tracking
• Lesson creation and management for teachers

3. User Accounts

To access certain features of the service, you may be required to create an account. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Providing accurate and up-to-date information
• Notifying us immediately of any unauthorised use of your account

4. Subscription and Payment

MTK offers free and premium subscription tiers:

• Free tier: Access to basic features including limited scale exploration, demo modes, and core visualisations
• Premium tier: Full access to all features including 80+ scales, 28 chord types, custom tunings, export features, and extended tempo ranges
• Teacher tier: All premium features plus lesson creation and student management tools

All payments are processed securely through Stripe. Subscriptions auto-renew unless cancelled. You may cancel at any time through your account settings.

5. Acceptable Use

You agree not to use the service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit any harmful, offensive, or inappropriate content
• Attempt to gain unauthorised access to our systems
• Interfere with the proper functioning of the service
• Scrape, copy, or redistribute our content without permission

6. Intellectual Property

All content, features, and functionality of MTK Rocks are owned by Musician's Toolkit Limited and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of our content without explicit permission.

User-generated content (such as custom lessons) remains your property, but you grant us a licence to display and distribute it within the platform.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the service, to understand our practices regarding the collection and use of your information.

8. Educational Use

MTK Rocks is designed for educational purposes. While we strive for accuracy in all musical information provided, we encourage users to consult with qualified music instructors for formal music education. We provide tools to support learning, not replace professional instruction.

9. Limitation of Liability

To the maximum extent permitted by law, Musician's Toolkit Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Service Availability

We strive to maintain high availability of our service but cannot guarantee uninterrupted access. We may perform maintenance, updates, or modifications that may temporarily affect service availability. We will endeavour to provide advance notice of planned maintenance.

11. Modifications to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes through the application or via email. Continued use of the service after changes constitutes acceptance of the new terms.

12. Termination

We may terminate or suspend your access to the service at any time for violation of these terms. You may also terminate your account at any time by contacting us or using the account deletion features. Upon termination, your right to use the service ceases immediately.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
